R.M. Palmer® “Your Big Mo’ment with Dale Jr.” Sweepstakes
Canadian Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING.
DATES OF PROMOTION: The “Your Big Mo’Ment With Dale Jr.” Sweepstakes (the “Sweepstakes”) begins at 12:01 a.m. Eastern Daylight Time (EDT) on January 10, 2008 and ends at 11:59 p.m. EDT on April 30, 2008 (the “Sweepstakes Period”).
ELIGIBILITY: The Sweepstakes is open to legal residents of Canada who are at least the age of majority in their province or territory of residence at the time of entry. Employees (or persons living in same household, whether related or not) of R.M. Palmer® (the “Sponsor”), and each of their respective parent companies, divisions, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Sweepstakes, including, but not limited to, the entities supplying the Prizes herein (the “Sweepstakes Entities”), are not eligible to participate. Sweepstakes is void where restricted or prohibited by law.
HOW TO ENTER: There are two (2) ways to enter the Sweepstakes:
1. WITH A PURCHASE: Purchase specially marked Palmer® Big Mo’™ Candy Bars to obtain a wrapped Game Piece (while supplies last) and unfold your Game Piece to reveal your Unique Code. Then visit www.BigMo-ment.com during the Sweepstakes Period and click on the “Canada” link and select the preferred language (either English or French), in order to be automatically directed to the Sweepstakes Entry Page. Then click on the “Enter with a Code” link and when prompted completely fill out the Official Online Entry Form, in its entirety, including First Name, Last Name, Address, City, Province/Territory, Postal Code, Daytime Phone Number (including area code), E-mail Address and your answer to the required skills testing question. Then enter your Unique Code and press the “Submit” button in order to receive one (1) entry into the Sweepstakes.
2. WITHOUT A PURCHASE: Visit www.BigMo-ment.com during the Sweepstakes Period and click on the “Canada” link and select the preferred language (either English or French), in order to be automatically directed to the Sweepstakes Entry page. Then click on the “Enter for Free” link and when prompted completely fill out the Official Online Entry Form, in its entirety, including First Name, Last Name, Address, City, Province/Territory, Postal Code, Phone Number (including area code), E-mail Address and your answer to the required skill-testing question. Then press the “Submit” button in order to receive one (1) entry into the Sweepstakes.
The mathematical skill-testing question must be answered correctly (unaided by electronic or mechanical device or otherwise) at time of entry in order to be eligible for the Drawing.
Upon verification, the potential Grand Prize winner will be notified by telephone on May 5, 2008, between the hours of 8:00 am (EDT) and 5:00 pm (EDT). See “Drawing” Section for further details.
Regardless of the method in which you choose to enter, either via the Purchase of a Palmer® Big Mo’™ Candy Bar, without a purchase, or via a combination of the two, there is a Limit of five (5) entries per person/household for the entire Sweepstakes Period.
In order for an online entry to be valid, entrant must have a valid e-mail address and must click the “submit” button. You must complete the entire registration and configuration process in order to be automatically entered into the sweepstakes. If you abort the registration and configuration process before it is complete, or if you intentionally un-configure before the end of the sweepstakes, you will not be eligible to win. Any attempt by any entrant to obtain more than the stated number of Unique Codes and/or submit entries by using multiple/different email addresses, identities, registrations, logins, and/or any other methods will void that entrant’s plays and that entrant may be disqualified from the Sweepstakes. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address. Potential winners may be required to show proof of being the authorized account holder.
DRAWINGS: Prize winners will be selected from among all eligible entries received during the Sweepstakes Period, on or about May 2, 2008, at 3:00 pm EST in Rochester, New York in a random drawing conducted under the supervision of The National Sweepstakes Co., an independent judging organization, whose decisions are based on their sole discretion and interpretation of these Official Rules, and are final and binding in all respects. Odds of winning depend upon the total number of eligible entries received.
PLEASE NOTE: All potential prize winners must have correctly answered the mathematical skill-testing question (unaided by electronic or mechanical or otherwise) at time of entry and prior to being awarded a prize. Potential prize winners’ who failed to correctly answer the mathematical skill-testing question, forfeit their prize and another prize winner will be selected.
Upon verification, the potential Grand Prize winner will be notified
by telephone on May 5, 2008, between the hours of 8:00 am (EDT) and 5:00 pm (EDT).
If the potential Grand Prize Winner can not be reached live on May 5, 2008 via telephone, he / she will be disqualified and an alternate winner will be selected
(Please Note: Potential Grand Prize Winning notifications will not be left on answering machines).
PRIZES:
1. GRAND PRIZE: (1) Grand Prize
of a VIP “Weekend at the Race” Prize Package will be awarded. Prize Package for One (1) winner and three (3) guests includes; (a) Round Trip air transportation from the major airport nearest winner’s home to Charlotte, North Carolina;
(b) Limousine transfer from Airport to Hotel; (c) four (4) nights of hotel accommodations (quad occupancy) at Embassy Suites;
(d) one (1) in-room “Welcome Basket”; (e)
one (1) “Welcome Dinner” with Palmer Staff; (f) one (1) Limousine escorted day of shop tours and lunch with Dale Jr. at Jr. Motorsports®; (h)
one (1) Limousine escorted day at the “Busch Race” [includes VIP suite tickets at Lowe’s Motor Speedway]; (i) one (1) Limousine escorted day at the “Nextel Race” [includes VIP suite tickets at Lowe’s Motor Speedway]; (j)
one (1) Rental car to be used over the duration of the trip at winner’s sole choosing; and (k) USD $250 Spending money per person. The Approximate Retail Value (the “ARV”) of the Grand Prize trip is: USD $20,000.
Grand Prize Winner and travel companions must travel on the Sponsor Specified dates of May 22, 2008 through May 26, 2008 or prize will be forfeited and another winner selected. (See PRIZE CLAIM section of these Official Rules) Destination city, Celebrity, Airport, Airline, Hotel, and any other element of the Grand Prize Trip as described herein to be selected by Sponsor. Tickets/Itineraries are final once confirmed and may not be changed for any reason, other than at the Sole discretion of the Sponsor. The exact dates of activities will be dictated by the Sponsor and may be subject to change or cancellation. No responsibility is assumed by the Sponsor for any cancellation or rescheduling of any activities in whole or in part. Grand Prize winner and travel companions must travel on same itinerary and must have valid required travel documents (i.e., valid photo ID, passport, birth certificate) before departure. Grand Prize winner and travel companions are solely responsible for determining and obtaining, each at his/her own cost, required travel documents. All minors (based on age of majority in resident’s state) must be accompanied by minor's parent or legal guardian who must also be the prize winner. Driver of rental car must have a valid Driver’s License and be at least 25 years of age with a major credit Card. Any Rental Car insurance not assumed by the Sponsor (such as personal insurance coverage) will be at the sole choosing and responsibility of the Grand Prize Winner All expenses and incidental travel costs not expressly stated in the package descriptions above, including but not limited to, parking fees surcharges, airport fees, service charges or facility charges, meals, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of winner.
2. FIRST PRIZES: Five (5) First Prizes of a custom Big Mo’™ Genuine Leather Jacket will be awarded. The ARV of each First Prize is CDN $536.50. The total ARV of all First Prizes to be awarded is CDN $2,682.50.
3. SECOND PRIZES: One Hundred (100) Second Prizes of one (1) case of Palmer® Big Mo’™ Chocolate Candy Bars will be awarded. The ARV of each Second Prize is CDN $38.63. The total ARV of all Second Prizes to be awarded is CDN $3,862.80.
4. THIRD PRIZES: Two Thousand Five Hundred (2,500) Third Prizes of a Big Mo’™ Hat will be awarded. The ARV of each Third Prize is CDN $8.58.. The total ARV of all Third Prizes to be awarded is CDN $21,460.
The total ARV of all prizes to be awarded is CDN $49,465.30. No Prize substitution, except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a Prize of equal or greater value if Prize becomes unavailable due to reasons beyond the control of the Sponsor. Prizes are not transferable prior to award. The actual value of the Grand Prize trip may vary based upon point of departure, airfare fluctuations, and destination city. Any difference between stated ARV and actual value will not be awarded. No more than the number of prizes set forth in these Official Rules will be awarded. All prizes will be awarded. Limit of One (1) Prize per person/ household.
PRIZE CLAIMS: After first being contacted by telephone, and except where prohibited, the potential Grand Prize winner and travel companion must sign and return to Independent Sweepstakes Administrator, within three (3) days of being notified and no later than May 9, 2008, an affidavit of eligibility/liability/publicity release (the “Release”) in order to claim prize If potential Grand Prize winner fails to sign and return the Release or driver’s license within the required time period, potential Grand Prize winner forfeits their right to the Grand Prize and another winner will be selected. Potential Grand Prize Winner consents to use of his/her name, likeness, biographical information, and voice in advertising worldwide without additional compensation.
GENERAL RULES OF PARTICIPATION: This Sweepstakes is subject to the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to its conflict of laws principals. By participating in this Sweepstakes, entrants, and winners release each and all of the Sweepstakes Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Sweepstakes, and/or the receipt or use/misuse of the prizes awarded, including, without limitation, liability for personal injury, death or property damage. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects and not subject to appeal. Sponsor reserves the right permanently to disqualify from this Sweepstakes any person it believes has violated these Official Rules. All Sweepstakes materials and Game Pieces are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Sponsor’s liability for defective Sweepstakes materials and Game Pieces is limited to replacement while supplies last. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials, Game Pieces and mail submitted to Sponsor. All federal, provincial and local laws apply. In the event any portion of this Sweepstakes is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or this Sweepstakes, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes. Winning a prize constitutes permission for Sponsor and its agencies to use winners' names, addresses (city & province/territory), voices and/or likenesses for purposes of advertising, promotion and publicity, for this promotion only, without further compensation, unless prohibited by law. Sweepstakes Entities are not responsible for lost, late, misdirected, undeliverable or incomplete entries, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, subject to the approval of the RACJ in Quebec, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Sweepstakes Entities. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right, subject to the approval of the Régie, to cancel, terminate, modify or suspend the Sweepstakes and randomly draw from those entries received up to the cancellation/suspension date. For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the award of a prize may be submitted to the Régie only to help the parties reach a settlement. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
NO LIABILITY: By participating, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and Sweepstakes Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes.
INDEPENDENT SWEEPSTAKES ADMINISTRATOR: This Sweepstakes is being administered by The National Sweepstakes Company, 693 East Ave., Rochester, NY 14607, who is responsible for overseeing the awarding of all prizes, and whose decisions are final in regard to the conduct of this Sweepstakes.
